WHAT DOCUMENTS ARE REQUIRED OF APPLICANTS FOR TEMPORARY SPONSORSHIP (E.G., H-1B, TN, L-1)?
In general, certain documents are needed to ensure that the law firm has a complete professional and status history. Along with the completed applicant questionnaire(s), please forward to the sponsoring employer clear copies made from the originals (whenever possible) of the items listed below. Copies should be made on regular white 8.5 x 11 paper. Please send the documents by mail or overnight express. Scanned, copies sent by email may also be acceptable if legible.
FOR PRIMARY APPLICANT/EMPLOYEE:
Current and previous passport(s) used for admission/entry to the U.S., including all pages with information, admission stamps, visas and annotations - you may omit blank pages; (Please do not obscure pages. Remove I-94s and receipts from the passport prior to copying.)
If you are in the U.S., Form(s) I-94 (front and back);
Current and prior employment authorization documents, including EAD cards, Forms I-797 (all H-1B, L-1 and other approval notices issued on your behalf, even if not used), H-1B/L-1/TN petitions and applicable Labor Condition Applications filed for your previous employment (if available);
Educational degrees (both undergraduate and graduate);
Academic transcripts for all post-secondary educational institutions/colleges/universities attended (undergraduate and graduate, as appropriate);
Educational equivalency evaluation/report for foreign education, if applicable and available;
Certificates for training related to the job offer;
Professional licenses, certifications and memberships applicable to the job offer;
Current resume/curriculum vitae, including: names and locations of actual employers (the entity that paid you), job title, description of duties for each position held, and the beginning and end dates of employment; educational studies/degrees, name and location of academic institutions, and the beginning and end dates (month/day/year) of enrollment with each;
Letters or certificates verifying previous employment; (Optional unless applying for L-1, if you do not have a 4-year bachelor's or higher degree, or if your degree is in a field not directly related to the job offer.)
IF YOU ARE OR HAVE BEEN EMPLOYED IN THE U.S.:
Form W-2 for each year employed in the U.S.;
At least three paycheck stubs to verify recent employment;
IF YOU HAVE PREVIOUSLY HELD F-1 STUDENT STATUS,
All Forms I-20 (front and back);
Letter from university department or foreign student office attesting that you maintained F-1 student status at all times (if available);
IF YOU HAVE PREVIOUSLY HELD J-1 EXCHANGE VISITOR STATUS,
Forms IAP-66 and/or DS-2019 and I-797 (Approval of Waiver of 2 year foreign residency requirement, if applicable);
Any other immigration related documents not identified above, including approval notices for petitions/applications filed on your behalf, labor certifications (Forms ETA-750 or ETA-9089), letters or notices from INS/USCIS offices, etc.;
For any documents that are not written in English, we will need copies of both the original foreign language document and a certified translation of that document. (If you have questions about translations, please contact one of our staff.)
FOR APPLICANT SPOUSE AND CHILDREN:
Passport(s) used for admission/entry to the U.S., including all pages with information, admission stamps, visas and annotations - you may omit blank pages; (Please remove I-94s and receipts from the passport prior to copying.)
If in the U.S., Form(s) I-94 (front and back);
As applicable, Forms I-20, IAP-66, DS-2019 and I-797 (approval notices), and EADs;
For spouse, Marriage Certificate;
For each child, Birth Certificate; (Note: Must include the child's name, date and place of birth, and parents' names.)
Any other immigration related documents not identified above, including approval notices for petitions/applications filed on their behalf, labor certifications (Forms ETA-750 or ETA-9089), letters or notices from INS/USCIS offices, EAD cards, etc.;
Any applicable translations.
