Is it necessary to have a current nonimmigrant visa such as H-1B or L-1?
No. The main function of the visa — the stamp in your passport which was inserted by the U.S. Department of State — is to permit entry into the U.S. If one is in the U.S. and is maintaining one’s nonimmigrant status, the visa may be expired. However, if traveling overseas, a current visa is required for re-entry. Canadian citizens in most nonimmigrant classifications (including TN, H-1B and H-4, L-1 and L-2) do not need a visa to enter the U.S. They are “visa exempt.”
